High Tech Workers

The BC Employment Standards Act sets out basic minimum standards for most employees working in BC. However, there are some exceptions to these minimum standards for high technology professionals. For example, the overtime and statutory holiday provisions of the BC Employment Standards Act don’t apply to high technology professionals.

Are you not sure if an employee is a high technology professional? Does the employee:

  1. Analyze, design or develop information systems based on computer or other technologies;

  2. Analyze, design or develop scientific or technological products, materials, devices or processes;

  3. Carry out scientific research and experimental development; or

  4. Are engaged as a sales or marketing professional in relation to the above services, systems, products or research.

If yes, then the employee is a high technology professional. However, being involved in the retail sale of any of the above does not make an employee a high technology professional.
